netVaz.com is the name of the services provided on this website. The terms: us, we, our, and I, all refer to netVaz.com; the terms you and your, refer to you as the customer - user of services provided by netVaz.com. The term their refers to the customers of resellers. The term its used in the context similar to: [netVaz.com and its server owners] meaning people, or services connected with netVaz.com. When this term is used, it is considering the third parties, or people as a part of netVaz.com, and are included in the terms being stated.

When you signup with any netVaz.com services, you will be added to a mailing list, we will not give away or sell your email address. The mailing list is just to update you on the server status, planned downtimes, events, special offers, special/added features, etc.

1. Account Setup
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

2. Content
All services provided by us may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, including pornography.

  8. • Bruteforce Programs/Scripts/Applications
  9. • Mail Bombers/Spam Scripts
  10. • Banner-Ad services (commercial banner ad rotation)
  11. • File Dump/Mirror Scripts (similar to rapidshare)
  12. • Commercial Audio Streaming (more than one or two streams)
  13. • Escrow/Bank Debentures
  14. • High-Yield Interest Programs (HYIP) or Related Sites
  15. • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  16. • Sale of any controlled substance without prior proof of appropriate permit(s)
  17. • Prime Banks Programs
  18. • Lottery/Gambling Sites
  19. • MUDs/RPGs/PBBGs
  20. • Hateful/Racist/Harassment oriented sites
  21. • Hacker focused sites/archives/programs
  22. • Sites promoting illegal activities
  23. • Forums and/or websites that distribute or link to warez/pirated/illegal content
  24. • Bank Debentures/Bank Debenture Trading Programs
  25. • Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
  26. • Mailer Pro
  27. • Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)

3. Zero Tolerance Spam Policy
You are not allowed to send any sort of unsolicited emails through any servers used by netVaz.com. Double opt-in mailing lists are allowed, as long as you don't send out 50 or more emails at once. You must not send bulk email, legal or not, bulk being to 50+ recipients at one time. You can send emails as long as the comply with the CAN-SPAM act. People found to be spamming will be warned, and accounts disabled until they re-accept the Terms of Service, if they are found to be spamming again, they will be permanently terminated, and their contact details given to relevant authorities if requested. For our resellers, we will not terminate your account if people are found to be spamming under your account, we will suspend their account, and contact you, if there is no reply, we will terminate their account for you. If there are excessive amounts of material on a resellers account, we will be forced to suspend the whole reseller, until the problems are fully sorted out.

4. Payment Information
You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify netVaz.com. of your desire to cancel any or all services received, those services will be billed on a recurring basis.

5. Backups and Data Loss
Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

6. Money Back Guarantee
netVaz.com's shared and reseller servers carry a 30 day unconditional money back guarantee. If you are not completely satisfied with our hosting services within the first 30 days, you will be given a full refund. This guarantee does NOT apply to administrative fees, SEO services, unique IPs, SSL Certificates, TemplateMonster™ or ThemeForest (Envato Pty Ltd.) web templates, installation fees for custom software, or eNom® based services such as Business Listing, GoMobi, and domain name transactions. Web design fees for template customizations or custom website designs are fully refundable if the customer is not satisfied with the overall result.

7. Resource Usage
Users may not initiate the following:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc. b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed. c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. d) Run any software that interfaces with an IRC (Internet Relay Chat) network. e) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc

8. Hosting Plan Prices and Feature Changes
netVaz.com reserves the right to change hosting plan prices and/or features at anytime - which include, Disk Space, Bandwidth, Maximum CPU/RAM Usages etc. These changes, if implemented, will not affect prepaid periods and will ideally benefit the customer.

9. Indemnification
Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from netVaz.com's server.

10. Disclaimer
We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.

11. Suspension and Termination
If you or any of our reseller's client violate any of the above policies, netVaz.com reserves the right to suspend/terminate the account or reseller's client account at any time without any warning.

12. Changes to the TOS
netVaz.com reserves the right to revise the Terms of Service at any time without notice.
